In one recent case our attorney, Frank E. Piscitelli Jr., won a settlement against an at-home daycare provider on behalf of the family of a 14-month-old child. The daycare provider was responsible for the safety of four toddlers. She placed the 14-month-old, who was sleeping in a car seat, in a bath tub so she could clean her house. The child was awakened, and while attempting to get out of the tub the toddler turned on the hot water and suffered second-degree burns.
Initially, negligence was denied. After several depositions and a report our law firm obtained by working with a nationally renowned child safety expert, negligence was eventually admitted. The case was not settled until the court granted the family permission to pursue a punitive damage claim against the daycare provider. The case finally settled for the policy limit on the daycare provider's homeowner's insurance about a month before trial.
